The NHPA will implement an opt-out process, which means that businesses can only use data with your explicit permission. It also requires transparency about how companies utilize your personal data and the right to opt out of sharing your data with a third party and penalties for non-compliance. Similar to the GDPR it also prohibits discrimination towards consumers who have their privacy rights protected. For example the company shouldn’t charge you more for protecting your privacy, or offer discounts when they share your data.

Government Protection Law

Federal laws provide many types protection for the government. These include:

Freedom of Information Act (FOIA), 44 U.S.C. The Freedom of Information Act (FOIA) provides you with the right to obtain records that are held by federal agencies. The Privacy Act of 1975 (5 U.S.C. 552) protects your privacy by establishing policies that regulate the collection, maintenance and disclosure of personal information collected by federal agencies.

New York State’s Personal Privacy Protection Law (Public Officers Law Article 6-A, sections 91-99) recognizes the public’s concerns about privacy and limits the government’s collection, use, and disclosure of your personal information. It also prohibits state agencies from using «secret files» and forbids the disclosure of personal information without consent.

Whistleblowers are vital to keeping our government honest. Federal law protects federal contractors and grantees as well as subcontractors and subgrantees from reprisals for revealing fraud, waste, or abuse in federal grants or contracts.
